Terms of sale

Art 1 - Application field :
These general conditions of sale apply, without limitation or qualification to all sales concluded by APPRO ZAGAYA to buyers, not professionals, who want to acquire products offered for sale on its website namely :

- Food alcohol and spirits
- Health-Chemist
- Local Crafts

These conditions apply to the exclusion of all other conditions, including those applicable to sales in stores or through other distribution channels and marketing.

These terms and conditions are available at any time on this website and prevail if any, on any other version or any contradictory document.

Unless proven otherwise, the data recorded by APPRO ZAGAYA are all transactions.

The products presented on this website are offered for sale only on the Department of Martinique.

The product offerings are understood in the limit of stocks available and no specific commitment of Seller. The information on the availability of products are provided at the time of placing the order.

These terms remain in force until 31.12.2010.

Art 2 - Orders :
It is the customer to select the site on the products they wish to order, as follows :

1- To the left of the screen, click the MENU button on the product (eg canned), scroll down and select the product by clicking on the button "Order" (ie asparagus). Make the operation above as many times as needed to prepare your list of fueling (eg beverages, groceries, etc...).

2- To the right of the screen, click on "View Order".

At this stage, you can still change the quantity of items you have ordered

Caution ! click on "Update" to activate your changes. You can also delete items by clicking on the "TRASH" from the last column to the right.

The icon appears if your order is less than 200 euros. In this case click again on the MENU still left of the screen and repeat steps 1, 2 and 3.

3 - Choose your payment method
4 - To finalize your order click on "TO ORDER".
5 - Complete billing address, Check "PLEASE REFER TO AN ADDRESS FOR DELIVERY"
6 - The order summary appears (Article, total payment).
7 - Accept the terms and conditions to finally validate by clicking on "TO ORDER".
8 - The confirmation is on the screen, you send an email receipt and order confirmation.

The order must be confirmed by email or postal mail.

The sale will be considered final after sending the customer to confirm acceptance of the order by the seller by email or postal mail, and after receipt of the full payment due (50 % of the amount of the total order).

No order for less than 200 Euros TTC will not be accepted.

Any changes to the order by the customer can not be taken into account by the Seller in the limit of its possibilities and conditions to be notified by mail at least ten days before the delivery date on this boat at the dock .

Assuming that these changes could be accepted by the Seller, the amounts paid by Customer will be repaid within a maximum of 30 days from the notification of the inability to accept changes made by the Seller to type (unless one prefers to receive a credit).

Art 3 - Rates :
The products are supplied at the rates prevailing on the date of confirmation of order acceptance by Seller, established according to commodity prices and those charged by the suppliers of the Vendor. The price listed in the order confirmation and fixed and final.

Only fruits and vegetables may be subject to variation depending on the market.

Prices are in Euro inclusive.

They do not include processing fees, shipping and transportation...

Commands specific type to which these rates are not applicable, will be an estimate previously accepted by it. The estimate prepared by the Seller are valid for a period of fifteen days. An estimate is considered accepted only after paying a deposit of 30% of the total order.

Art 4 - Payment Terms :
4.1 - Terms of payment :
Participation on the processing fees, shipping and transportation on the Marina Marin is added to the command, as follows :

From 72 hours (working days) to 10 days before embarkation 8% of the total amount of the order will be applied in addition.

Any order made more than 11 days before the delivery date will result in a 2% discount on the amount of delivery.

The balance is payable in cash on the day of delivery, as specified in section "Delivery" below.

The Seller shall not be required to make delivery of goods ordered by the Customer if it does not pay him the money in the terms and conditions listed below.

Marina Pointe du Bout, Anse Mitan Francis processing fee, shipping and transport 10% a minimum of 60 € will be charged to this title

4.2 - Settlement Terms :
Payment by the Customer will be considered final only after actual receipt of money owed by the Seller.

The settlement of purchases can be made either by credit card VISA, VISA, MASTERCARD online, by phone, by check issued by a bank domiciled in France, money order, only for orders exceeding 200 € of goods.

4.3 - Retention of property :
Failing to pay all or part of the total order and delivery, the Seller reserves, until full payment, ownership of the goods sold, allowing it to repossess those goods.

Any deposit paid by Customer forfeited to Seller as a lump sum compensation, without prejudice to any other actions that would place to bring this fact against the client.

Art 5 - Delivery :
The date, time, place of delivery is chosen by the customer when ordering, however, the slot can be modified for technical reasons in consultation with the Customer. Once approved by the parties, a range schedule will be defined and will be considered late overruns of more than an hour from the end of the range high. Seller agrees to make every effort to deliver products ordered by Customer within the time specified when ordering. All times if the goods ordered were not delivered within the time above mentioned sale will be resolved at the written request of the customer. The amounts paid by Customer will then be returned without delay to the exclusion of any compensation or deduction.

The Seller shall in no event be liable for a failure to honor its commitments in case of strike, fire, storms and cyclones, accidents and the impossibility of being supplied.

Delivery is deemed completed upon delivery of products by Seller to Customer.

If requests of the Client's requirements concerning packaging and transportation of products ordered, duly accepted in writing by the Seller, the costs will be billed separately supplementary estimate on the previously accepted by the Customer.

Customer is responsible as they arrive to check the apparent condition of the products. At the slightest problem, Customer may reject the product damaged, broken, non-compliant (when specific order) and restore upon delivery. The product under investigation or will be changed or refunded immediately.

Art 6 - Transfer of ownership :
The transfer of ownership of the products of Seller in favor of Customer shall be made only after full payment of money by him, and whatever the date of delivery of such products

In contrast, transfer of risk of loss or damage to Seller's products will be made once the goods are on board. The Seller shall not be held responsible for the preservation of products beyond the delivery on board the boat.

Art 7- Right of withdrawal :
The Customer has a right of withdrawal for 10 days before the day of delivery except for special orders, luxury or not located on the island market.

Art 8 - Supplier's liability Guarantee :
In order to assert his rights, the Customer must be present on the day of delivery, under penalty of forfeiture of all related activities. He will refuse, from Seller, all products whose packaging seems unnatural.

The Seller will replace or refund or replace products deemed defective. This warranty covers any costs.

The products sold on the website comply with the regulations in force in France. The Seller's liability can be incurred for non compliance of the country where the goods are delivered, it is the Customer to verify.

The Client is solely responsible for the selection of products, their storage and use.

The Seller shall not be held responsible for any default or delay or failure resulting from the occurrence of a force majeure usually recognized by the French jurisprudence.

Art 9 - Computer and Freedoms :
Under Law No. 78-17 of January 6, 1978, it is recalled that the data which are requested to Customer are required to process the order and are intended for internal use by the Seller. These personal data may nevertheless be transmitted to third parties, partners of the Seller. The Customer has a right of access, modification, rectification and opposition with respect to information concerning, as provided by law and regulations.

Art 10 - Litigation :
All disputes regarding this contract may result on both the validity, interpretation, performance, termination, their consequences and their consequences will be submitted to the court of FORT FRANCE.

Art 11 - Language of Contract Law :
Express agreement between the parties, this agreement is governed by and subject to French law.

For convenience, an English translation has been established. However, in cases of dispute, only the French text would be authentic.

Art 12 - Acceptance of Buyer :
The fact that an individual or legal order on the website of SUP-ZAGAYA SARL membership entails and full acceptance of these Conditions of Sale, which is expressly acknowledged by the Client, which waives, in particular, to advantage of any contradictory document, which would be void against the Seller.
